每年到了Q4季度，戶外燈串類產(chan) 品大促，不少燈具熱銷；不論是萬(wan) 聖節、感恩節還是聖誕季，都是燈具產(chan) 品爆火銷售的時段；而在這個(ge) 緊要關(guan) 頭，積特收到不少燈具賣家反饋，自己的listing被下架，回款被暫停，無疑是當頭一棒。

根據業(ye) 內(nei) 相關(guan) 人士透露，本次TRO已有上千家店鋪遭殃，而且代理律所是國內(nei) 律所，TRO通知郵件中要求賣家停售多個(ge) 戶外燈具類目產(chan) 品；在這份被告名單中，不乏月銷百萬(wan) 、留評過萬(wan) 、好評高達4.8的頭部賣家。

不少買(mai) 家反饋，該類目下多款商品都被卷入本次風波，更有甚者被對方獅子大開口，索要上百萬(wan) 的賠償(chang) ：

“我朋友的公司有三個(ge) 平台在銷售這款產(chan) 品，店鋪均被TRO，和解金被要了107萬(wan) 美金”

“第一次收到TRO，沒想到還是國內(nei) 的律所。看了一圈名單，才發現收到TRO的賣家這麽(me) 多。”

“我們(men) 也被TRO了，要十來萬(wan) 美金的和解金。”

“和解金是銷售額的7%，我被要了5.5萬(wan) 美刀。”

......

據了解，本次被TRO的燈具類目中，主要針對戶外燈串類目G40燈泡和S14燈泡，不僅(jin) 僅(jin) 是亞(ya) 馬遜平台，其他的跨境平台像TEMU、eBay、Shein等都有賣家被投訴。

有不少賣家猜測，此次TRO是惡意為(wei) 之，本次TRO是侵權了一項15年前的發明專(zhuan) 利，很難與(yu) 現在銷售的產(chan) 品聯係起來，但是產(chan) 品的功能又與(yu) 該發明專(zhuan) 利的功能相似或重疊；這就意味著，賣家們(men) 很難確定自己是否真的存在侵權行為(wei) ，一著急直接承認自己侵權，慌亂(luan) 尋求和解。

在亞(ya) 馬遜上，搜索燈泡，仍然有不少在售的G40燈泡和S14燈泡，目前仍在售該產(chan) 品的賣家也要注意侵權問題；而經過檢索，我們(men) 也發現了許多燈泡都已經注冊(ce) 專(zhuan) 利，賣家們(men) 要一同規避：

那麽(me) ，本次案件涉及的賣家們(men) ，如何確定是否存在侵權行為(wei) ？又應該如何應對呢？

案件涉及侵權專(zhuan) 利解讀

本次案件涉及的是發明專(zhuan) 利，專(zhuan) 利號：US7819545B2，

這件專(zhuan) 利僅(jin) 包含3個(ge) 權利要求，且隻有1個(ge) 獨權，如產(chan) 品不落入權1的保護範圍，則不侵權該專(zhuan) 利權：

1. An outdoor decorative solar powered lighting system, comprising:

a flexible, elongated light string;

an electrical wire extending through the light string and commensurate in length therewith;

a plurality of sockets mounted on the light string and spaced evenly therealong;

a plurality of light bulbs mounted to the sockets with one light bulb being mounted to each respective socket;

a solar collector electrically connected to the light string and including a bottom side and an upper side;

the solar collector including a housing and at least one solar panel supported in the housing for collecting radiant energy from the sun;

a rechargeable battery contained within the housing and electrically connected to the solar panel for providing energy to the rechargeable battery; and

a regulator switch electrically interconnected to the battery and the light string for automatically switching the light bulbs on and off whereby the switch is disposed to the open state from sunrise to sunset thereby preventing the light bulbs from lighting and the switch automatically going to the closed state upon sunset thereby closing the circuit and causing the light bulbs to light.

一戶外裝飾太陽能照明係統, 包括:

一柔性的細長燈串;

一電線，穿過燈串並與(yu) 其長度相當;

多個(ge) 插座安裝在燈串上，且沿燈串均勻分布;

多個(ge) 燈泡安裝在插座上，且每個(ge) 插座各對應安裝一個(ge) 燈泡;

太陽能收集器，與(yu) 燈串電連接，且包括底麵及頂麵;

太陽能收集器包括殼體(ti) 和至少一個(ge) 支撐在殼體(ti) 中用於(yu) 收集來自太陽的輻射能的太陽能板；

可充電電池，容納於(yu) 殼體(ti) 內(nei) 且電連接太陽能板，用於(yu) 向可充電電池提供能量; 及調節開關(guan) ，與(yu) 電池和燈串電連接以自動打開和關(guan) 閉燈泡,其中開關(guan) 從(cong) 日出到日落被設置為(wei) 打開狀態，以防止燈泡點亮，且開關(guan) 在日落時自動進入關(guan) 閉狀態，以關(guan) 閉電路並使燈泡點亮。

通過以上分析可知，此件專(zhuan) 利主要包括 燈串、電線、插座、燈泡、太陽能收集器、可充電電池及調節開關(guan) 這些結構，且通過上述連接方式使得太陽能轉換為(wei) 電能，進一步進行照明，所以如產(chan) 品缺少其中某個(ge) 結構，會(hui) 與(yu) 專(zhuan) 利形成區別。

簡而言之：假如我們(men) 的產(chan) 品缺少其中某個(ge) 結構，則侵權風險低；比如，假設你售賣的是直插電的燈泡，是不落入對方的權利保護範圍，則侵權風險低；若全部具備，則侵權風險高。
